I need to know how to file without an injured spouse form to get my money and not my husbands ex..help please?

Ok, so my husband owes money to his ex for backed child support and I’m fine with her getting his portion of our tax return, but not mine! How can I get my money, without filing an injured spouse form? I was told that any money owed would still be held for like 6 months with this form and then I would get my money. I need money back like now. What do I do?

You’ll need to file as an injured spouse….any tax preparer will know what to do then. That’s the only way to keep your portion unless you file seperately. I had the same situation….they took my tax return portion for 2 years before someone suggested the injured spouse thing. The positive part of them taking mine along with his is that the back child support was paid off quick. You’ll get your return in the same amount of time (up to 12 weeks) with the injured spouse….those are really your only choices.
